COASTALCOALITION
The Coastal
Coalition is an umbrella group formed to unite
people who believe the foreshore &
seabed is
the birthright and common heritage of all New Zealanders
equally and
should remain in Crown ownership. We
have no affiliation to
any political party.
CITIZENS INITIATED
REFERENDUM The Coastal Coalition's Citizens Initiated Referendum
is being promoted by Dr Muriel Newman and
Dr Hugh Barr on behalf of the Coastal
Coalition. The petition question asks:
Should
the Marine & Coastal Area (Takutai Moana)
Act 2011 be
replaced by legislation that restores Crown ownership
of the foreshore and seabed?
If
we gather the support of 10 percent of
registered voters (that's 320,000 signatures -
equivalent to the population of Wellington
plus Hamilton!)
by next June for our petition
question then the government will be required
to hold a nation-wide referendum of all

With all political parties - except National
and the Maori Party - strongly opposed to the Marine
and Coastal Area Act, a successful referendum
will provide a mandate for the new government
to repeal this disastrous law.

HISTORY
OF THE COASTAL COALITION CAMPAIGN We
have left the website below intact as a
record of our campaign to oppose the Marine
and Coastal Area Bill. Many New Zealanders
still have no idea what the law change will
mean, so we hope that by browsing through
the material produced during our campaign,
we can help inform people about why
National's dreadful law to privatise our
coast to corporate iwi needs to be repealed!
MESSAGE
TO ALL COASTAL COALITION SUPPORTERS:
This letter is to thank you most
sincerely for your support during our
campaign to oppose the Marine and
Coastal Area Bill.
Everyone has worked so hard on the
campaign that it is extremely
disappointing to see that National was
prepared to ignore overwhelming public
opposition and force their bill through.
However, in spite of the final outcome,
collectively, we have all made a huge
difference. Dont forget that when
National first announced their law
change, they wanted it passed by
Christmas. Then they tried to pass it
through Parliament under urgency just
after they got back from the Summer
break. If it hadnt have been for our
opposition, they probably would have
succeeded!
Nationals whole approach was based on
half truths - keeping New Zealanders in
the dark not only about the radical
nature of the bill, but also about how
they were sacrificing our coast for the
Maori Partys support and another term
in office.
The Coastal Coalitions public
information campaign was designed to
alert the public to what was going on.
Networks of volunteers were quickly
built around the country to inform
locals through fliers, letters to
newspapers, calls to talkback radio, and
a myriad of other initiatives.
Billboards were erected around the
country and a series of major national
newspaper advertising campaigns were run
in conjunction with email campaigns. As
a result of our efforts, the select
committee dealing with the bill received
many thousands more submissions than
they would have expected, and Members of
Parliament were inundated with messages
appealing to them to oppose the bill.
It was a truly Herculean effort!
I would like to pay a special tribute to
the enormous contribution of Hugh Barr
our spokesman and Geoff Parker our
national volunteer coordinator, who like
me have worked full time on this
campaign on a voluntary basis since last
May, when the Coastal Coalition was
first formed.
The fact that in spite of our best
efforts the bill was forced through with
no public mandate and in spite John
Keys promise that it would not go
ahead if the public were not in support
- demonstrates a real failure of
democracy in New Zealand. In addition,
National MPs displayed an appalling lack
of backbone by privately admitting they
did not support the bill, while publicly
turning their back on constituents to
vote for it.
Many of you would have heard
Nationals claims that they were not
worried about upsetting the public by
passing the bill because voters would
have forgotten all about it by the time
the election came around. Well, on
behalf of the tens of thousands of
Coastal Coalition supporters of all
races, all political persuasions, and
all walks of life, I can tell the
National Party that we are not prepared
to let this matter rest. We are looking
at launching a Citizens Initiated
Referendum (CIR) to repeal the new law
and reinstate Crown ownership of the
foreshore and seabed. We believe all New
Zealanders deserve to have their say on
this divisive law, which will affect the
whole country and all future

This whole debacle has served to remind
us that when a government goes off the
rails, New Zealands democratic system
provides no checks and balances with
which to undo the damage. Thats why,
through the New Zealand Centre for
Political Research, I have been
researching this issue to see what
safeguards exist in other jurisdictions

It seems to me that New Zealand needs a
mechanism similar to the US Ballot
system - which has been in place for
over 100 years ago in over half of the
US States - that not only enables
citizens to promote legislative change
but allows them to veto unacceptable
laws that are being forced through by
their legislature.
This whole foreshore and seabed debate
is really about the wider issue of what
sort of country we want in the future. I
believe the Coastal Coalition and
most other New Zealanders want one
nation not two. Thats why we have
been fighting so hard against the Marine
and Coastal Area Bill. And while we have
suffered a set back through the passing
of the bill, this is a battle that is
certainly not over!

Citizens
Initiated Referendum over Marine &
Coastal Area Act
The Coastal Coalition has responded to
the passing of the Marine and Coastal
Area (Takutai Moana) Bill through its
final stages in Parliament today, by
announcing it will launch a Citizens
Initiated Referendum to repeal the new
Act.
Dr
Hugh Barr and Dr Muriel Newman, joint
Coastal Coalition spokespeople said,
We have decided to proceed with the
referendum because the majority of New
Zealanders are strongly opposed to the
Bill. Kiwis want to be treated as one
people not two.
While
most people agree with the principle of
settling outstanding historical Treaty
injustices, they believe that repealing
public ownership of the foreshore and
seabed - so it can be privatised and
gifted to Maori - is a step too far.
The
public believed the Prime Minister when
he promised that if the new law did not
receive popular support he would not
push it through. The Marine and Coastal
Area Bill has almost no public support -
over 95 percent of submitters were
opposed. Yet today the Prime Minister is
pushing it through. He has broken his
promise and betrayed the New Zealand
public.
The
Coastal Coalitions campaign to oppose
the Marine and Coastal Area Bill has
been supported by tens of thousands of
New Zealanders from all walks of life,
all ethnic groups and all political
persuasions. This Referendum will be
launched on their behalf and will give
all New Zealanders a chance to say that
they do not want a bar of this new law.
The Coastal Coalition believes all
people should be treated equally under
the law and that New Zealand should be
one country not two. We strongly oppose
the law change and we look forward to
giving New Zealanders a chance to have
their say on this divisive
legislation, Dr Barr and Dr Newman
said.

the submissions to the government's review of
the Foreshore and Seabed Act 2004. It shows
77% were opposed to repealing Crown ownership
and 91% were opposed to the government's new

Background
to the Foreshore and Seabed legislation
The foreshore and seabed is a massive resource
that comprises around 10 million hectares one
third of the land mass of New Zealand.
Horizontally it is the distance between the
average spring high tide waterline and the 12
nautical mile territorial limit.Included are the beds of rivers that belong
to the coastal marine area.Vertically it is the airspace above this
zone and the water, subsoil, bedrock and other
matters like mineral wealth below.
The foreshore and seabed were vested in the Crown
when New Zealand adopted British common law in the
1800s.
As a result of a Court of Appeal decision
in 2003, which was widely misrepresented to imply
that Maori owned the foreshore and seabed, the
Labour Government affirmed Crown ownership through
the 2004 Foreshore and Seabed Act.
The National Party
wants to repeal Crown
ownership of the foreshore and seabed in favour of
Maori interests. They believe this will cement a
long-term relationship with the Maori Party.
Under Nationals
bill,
corporate iwi will be given
effective ownership of the foreshore and seabed,
not through a rigorous Court process but through
negotiation with government Ministers. Their
rights would include the power of veto over other
coastal operators, and the potential for
widespread development resorts, mining,
aquaculture,
and so on.
What's
next?
The government
is planning to repeal Crown ownership of the foreshore and
seabed before the end of summer. It is very important that
everyone who wants to see Crown ownership retained contacts
National Party MPs to tell them that they will not get your
support at the election if they go ahead and pass this law. MP

In fact, if
Crown ownership of the foreshore and seabed is to be preserved
the public need to express outrage. But they first need to be
informed! That's why the Coastal Coalition is building a network of concerned citizens who
are spreading the word
about what is going on and encouraging everyone who shares our concerns
to sign up - using the form above. Those who
aren't in a position to help but would like to be kept
